Justice delays in courts due to delayed reports from labs, 13308 reports pending in Haryana

Justice usually delays in courts for  a long time due to non-receipt of reports from Forensic Science Laboratories (FSL) when cases are under trial in courts and accused involved in serious crimes like murder, rape and poisoning to death remain not only in open but also delay makes case weak. According to information, 13308 forensic reports of cases under trial in courts are pending since a long time in five FSL in Haryana state which include the biggest FSL at Madhuban in Karnal district and five Regional FSL at Bhondsi in Gurugram district, Panchkula, Hisar  and forensic science laboratory Rohtak. There are also large numbers of viscera report awaited in courts across the state. According to complainants, their cases remain pending in courts as well as in Fast Track Courts for a long times in the absence of such reports to be submitted by forensic laboratories in the state and they are forced to visit court against and again on hearings in the court on every date  thus having delay in getting justice.

Courts usually require DNA test report for identification of victim in murder cases, for identification of victim female as well as accuse in sexually exploitation (rape and gang rape) cases and according to judges reports of such cases are usually delayed for a long time thus giving decision in these   cases and in-spite of several reminders action not taken by Forensic Science Laboratories usually blame shortage of staff as well as infrastructure prime reasons for the delay in such laboratories. Information reveals that 1572 DNA test reports are also pending with FSL in the state at present. Sometime ago the question for delay in submitting reports by FSL in the state was raised in Vidhan Sabha session when state government had assured relief to complainants in this regard but to no result. On the report of National Human Right Commission direction was given to bring all Forensic Science Laboratories under the control of Ministry of Home Department which are still unimplemented and these are functioning under the control of Director an officer of IPS rank in the state.

On the basis of collected data as regard pending cases in various laboratories in Haryana state, there are total number of 7534 reports lying pending at FSL Madhuban which include 1757 reports related to verification of documents, 1604 reports related to NDPS cases, 1369 reports related to texicology, 613 reports related to Physics (weapon used in crime), 426 reports related to belistics (type of weapon from which bullet was shot), 114 reports related to cerology (blood spots at the place of incident) 42 reports related to biology (identification of bones) and 35 reports related to chemistry( cases in which accused are caught red-handed) and 2 reports of identification of photographs).

In case of FSL Bhondsi (Gurugram) out of total number of 2902 pending reports include 21 21 reports related to texicology, 455 reports related to documents, 248 reports related to NDPS cases and 75 reports related cerology. In case of FSL Panchkula out of total number of 29 reports pending so far include 14 reports each related to toxicology and biology and one report related to cerology. As regard total number of 150 pending reports at FSL Hisar include 78 reports related to NDPS cases, 74 reports related to  texicology, 2 reports related to Cerology and one report related to biology.
