Manesar IMT expansion, Haryana introduces no litigation policy -2023 to benefit farmers

The state government had notified land measuring approximately 1,810 acres under Section 4 of the Land Acquisition Act, 1894, on January 10, 2011, for the development of Manesar Industrial Model Township (IMT) expansion in three villages Kasan, ,Kukrola and Sehravan in Manesar tehsil. Now ,Haryana Cabinet has approved the ‘no litigation policy-2023’ for the land acquired for the expansion of Manesar Industrial Model Township  aiming at the fast-tracking of this developmental project with voluntary participation of land owners or the farmers, and to ensure them acceptable compensation with assured incentives in the form of developed land. This policy will make land owners had protest against the low compensation for their acquired land.
The state government had notified land measuring approximately 1810 acres under Section 4 of the Land Acquisition Act, 1894, on January 10, 2011, for the development of Manesar Industrial Model Township expansion in villages Kasan, Kukrola and Sehrawan when the Supreme Court, in April 2011 granted a stay on the acquisition proceedings and the stay was vacated in December 2019 and thereafter the said land was notified under Section 6 of the Land Acquisition Act, 1894, on August 17, 2020 and subsequently award was announced on August 8, 2022 by the chief minister.

 The landowner expressed dissatisfaction on the acquisitions of their land by the government initiated in 2011. Several meetings conducted with the affected land owners brought them unsatisfaction over land acquisition when an assurance was given by the Chief Minister Manohar Lal Khattar during Haryana Vidhan Sabha session on August 9, 2022 that the Rehabilitation and Resettlement Policy 2010 would be revised for this acquisition to ensure appropriate rehabilitation to the  landowners, said a government officer as such a specific policy has now been prepared for rehabilitating the land owners whose l1758 acres land was acquired in the three villages Kasan, Kukrola and Sehravan in Gurugram district under Section 4 of the Land was acquired Acquisition Act, 1894 on January 10, 2011. The policy provides an option for receiving better benefits if they submit an undertaking to the government in the prescribed format duly attested by Tehsildar cum Executive Magistrate of Manesar.

According to the new policy the land owner allows entitlement of 1,000 square metres developed land/plots against one acre land. The farmers/landowners will have the right to opt for the scheme within a period of 6 months from its notification to ensure instant benefit to the land owners in which Haryana State Industrial & Infrastructure Development Corporation (HSIIDC) will issue Land Entitlement Certificate on the allotment share of land owners within a period of three months from the closure of the scheme.The land owners will get entitlement certificates and have the freedom to trade, buy or sell the Land Entitlement Certificates. This implies that the landowner can monetize the certificate in the open market or sell back to the HSIIDC.

According to no litigation policy, the landowner shall also be entitled to avail the benefit of annuity payment at the rate of Rs 21,000 per acre per year for a period of 33 years. This amount will also be increased by a fixed sum of Rs 750 every year in order to make policy acceptable and benefit to the farmers on the lines of Land Pooling Policy 2022, the land owners of land entitlement certificate may also request HSIIDC to buy-back the land entitlement certificate at a price of Rs 35,400 per sq mtr if they do not avail annuity payment incentive
