Haryana cabinet expansion challenged in the High Court

Saini government in Haryana has appointed eight new ministers in the state, seven of them are newcomers. None of the six independent MLAs who have offered their support to the new government in Haryana have been inducted into the new BJP government so far. Former Chief Minister Manohar Lal Khattar, Haryana Governor Bandaru Dattatraya, Ruling Chief Minister Nayab Singh Saini along with the newly inducted state ministers had the oath-taking ceremony at the Raj Bhawan in Chandigarh on Tuesday. The new ministers included in the Haryana Cabinet are: Badkhal MLA Seema Trikha, Panipat Rural MLA Mahipal Dhanda, Ambala City MLA Aseem Goel, Nangal Chaudhary MLA Abhey Singh Yadav, Thanesar MLA Subhash Sudha, Bawani Khera MLA Bishamber Singh Balmiki and Sohna MLA Sanjay Singh who were sworn in as ministers of state (independent charge). Kamal Gupta, minister in the previous Khattar government cabinet was the first to be administered oath as a cabinet minister.


A writ has been filed in Punjab and Haryana High Court by an advocate Jagmohan Bhatti demanding immediate hearing in the case as regard illegal expansion of ministers in the state assembly having strength of 90 MLAs in the House, stating that there should be only 15% ministers, as such should have 13 ministers in the state as against 14 ministers took oath at present, which is merely violation of 91st Amendment of the Indian constitution Act. The applicant stated that the appointment of Haryana Chief Minister Nayab Singh Saini , too, is against the law and notice in this regard has also been  submitted in the court. According to applicant submitted writ in the court, there are 14 newly appointed ministers in the state government took oath, apart from the Advocate General also having rank of a Cabinet Minister, thus identifying total number of 15 ministers in the state as against 13, which is violation of 91st  Amendment the Indian Constitution Act  91 of the constitution which require immediate hearing on the writ before the Bench of Acting Chief Justice.The applicant alleged that the expansion of ministers after the code of conduct announced in the state was illegal.
