Over 4.5 lakh civil cases are under trial in High Court delaying justice

Information reveals that more than 4.5 lakh civil cases including vehicle accident claims are lying pending in Punjab and Haryana High Court Chandigarh delaying justice especially to accident victims or their families which include more than12000 cases yet pending under trial in the court since past 20 to 30 years, about 59407 cases  lying pending under trial in the court since past 10 to 20 years and 57612 cases yet under trial in the court for decision since past 5 to 10 years. The worst affected are those victims or their families deprived of having compensation since past many years either they died or severely injured.

Information also reveals that thousands of fresh accident claim cases which include between eight to ten thousands claims for the compensation are registered in High Court every year and the number of such cases fast increasing but delayed for years due to one reason or the other due to legal complication generally objections raised by the insurance company as a result such cases remain hanging in the court for trial for a long time and victims or their family have to spend huge amount towards legal fee to advocates, besides struggling as well as harassment in courts to get compensation and most of them even stop fighting the case in-spite of spending huge amount towards legal fee hoping not to get relief as well as justice.

According to information, apart from High Court there are large numbers of accident claim cases pending before tribunal in districts in the state causing lot of inconvenience to accident victims and their families generally due to various technical reasons including not submitted accident information report (AIR) within prescribed 30 days period, incomplete AIR report without site plan of the place of accident, condition of road where mishap took place, mechanical condition of the vehicle, incomplete data base to find out the reason of accident which are some of prime reasons for delay in such cases in which accident victims or his/her family have to suffer delay in getting justice and compensation towards accident claim for a long time and in few cases fails to get the same due to technical reason.

According to legal experts, there are few lapses in motor accident claim tribunal policy when accident victims or their families fail to get compensation amount for which there is need to modify policy in such cases where the vehicle cause accident could not be identified and the accident victims fail to get compensation amount in hit and run cases and there should be a provision by the government to provide compensation relief to victims or their family.
