PIL filed in HC challenges new Haryana CM Nayab Saini’s appointment

Chandigarh, March 13, 2024 :   A Public Interest Litigation (PIL) has been filed today in the Punjab and Haryana High Court challenging the appointment of Haryana’s new Chief Minister Nayab Singh Saini, who is also a BJP’s Lok Sabha MP from Kurukshetra.The matter is yet to be listed for hearing.

The petitioner, Advocate Jagmohan Singh Bhatti along with the appointment of the CM Haryana, Nayab Singh Saini (Member Parliament, from Kurukshetra), has also challenged the appointment of the five cabinet ministers, Kanwarpal Gujjar (MLA Chachrauli), Moolchand Sharma, Ranjit Singh (MLA Independent Rania), JP Dalal (MLA BJP Loharu), and Dr Banwari Lal (BJP MLA Baval).

The PIL has been filed by Advocate Jagmohan Singh Bhatti, mentioning in the petition that the appointment of firm member of Parliament elected and sitting from the Kurukshetra, has been appointed as Chief Minister of the Haryana State without having his resignation from the parliamentary seat which he is holding as a Member of Parliament and without resigning he has been administered the oath of secrecy as a Chief Minister of the State of Haryana.

It has been added in the petition that the Chief Minister holding office of profit under the government of India being a Member of Parliament as a sitting member and simultaneously he has been administered the oath of Chief Minister of the State of Haryana, is in conflict with the Constitution of India and under the representation of people Act, 1951.
Bhatti seeks freezing of the salaries, other financial benefits and facilities provided to the Chief Minister and Cabinet Ministers.
