Chandigarh : The Punjab and Haryana High Court has asserted its authority over the Model Code of Conduct, stating that no election-related guidelines can hinder the execution of its orders. In a recent ruling, Justice Rajbir Sehrawat emphasized that directives from the Election Commission or any other authority cannot impede the High Court’s decisions. The court’s firm stance came in response to a contempt petition regarding the appointment of a constable in Haryana, where the state cited the Model Code of Conduct during elections as a reason for non-compliance. Justice Sehrawat clarified that such excuses are unwarranted, reaffirming that the court’s orders must be executed without delay, regardless of electoral constraints. The ruling serves as a reminder to Punjab, Haryana, and Chandigarh that adherence to High Court directives is obligatory, overriding any electoral considerations unless specifically stayed by a higher court.
